SIA “Ģimenes sirds”, reg. no. 50203085391, address Gāles iela 27, Sigulda, LV-2150, Latvia, hereafter — the online store — provides the website content and supplies goods/services under the following Terms of Use.
General provisions
When a consumer purchases goods/services using the website, such agreement is regarded as a distance contract and is governed by the laws of the Republic of Latvia regulating distance contracts (including but not limited to the Consumer Rights Protection Law, Cabinet of Ministers Regulations on Distance Contracts).
How to make a purchase
Product prices and specifications are displayed beside the products in the store. To place an order: add desired items to the cart, fill in all required fields and choose an appropriate delivery method. The total cost including shipping is shown on screen. Then complete payment to finalize the order.
Payment terms
Currency: euro. Payment methods via payment platform makecommerce.lv, Maksekeskus AS:
- Latvian internet bank payments: Swedbank, SEB, Citadele, Luminor
- Visa/Mastercard card payments
When using internet banking, confirm the order and click “Return to merchant”. Personal data needed for payment are forwarded to Maksekeskus AS. The contract enters into force once payment is credited to the online store’s account.
If for any reason the order cannot be fulfilled, the Buyer is informed and the amount paid is refunded as soon as possible but no later than 14 days after notice.
Delivery terms
Goods are delivered to: Latvia, Lithuania, Estonia. Delivery via parcel-locker partners. All duties and taxes required to receive the shipment at destination must be covered by Buyer. Delivery costs are shown before order confirmation. Goods are delivered to the Buyer’s address within 3-5 business days. In exceptional cases the store may dispatch goods up to 45 calendar days, after notifying the customer.
Withdrawal rights
The Buyer has the right to withdraw from the contract within 14 calendar days from the receipt of the goods. (Depending on the type of product, the right of withdrawal may not apply; in such case reasons must be clearly stated and explained.) The right of withdrawal does not apply if the Buyer is a legal entity. To exercise withdrawal rights, goods must have been used only for the purpose necessary to establish their nature, characteristics and functioning. The Buyer is responsible for maintaining the quality and safety of goods during the withdrawal period.
If goods are improperly used, damaged, or packaging is lost or materially damaged, the store may reduce the refundable amount in line with the goods’ value reduction.
To use the withdrawal right, the Buyer must submit a withdrawal form (for goods here; for services here) by e-mail to gimenessirdsveikals@gmail.com within 14 days from receipt. Returns are sent free of charge. Buyer must return goods to Seller without undue delay, and no later than 14 days after sending the withdrawal form.
Upon receipt of returned goods, the store refunds all payments without undue delay but no later than 14 days. Seller may withhold refund until receipt of goods or proof of return. If Buyer chose a delivery method other than the least expensive standard delivery, the store is not obliged to refund the extra delivery cost.
Consumer rights for non-conforming goods
The store is responsible for goods’ non-compliance with contract terms or defects occurring within 6 months of delivery if not inconsistent with nature of goods. Buyer must notify Seller of defect without undue delay, i.e., within 2 months of detection. Complaint can be submitted by e-mail to gimenessirdsveikals@gmail.com.
The store is not responsible for defects occurring after delivery. If goods have defects for which Seller is liable, Buyer may demand repair or replacement at no charge. If repair or replacement is impossible, Seller shall refund all payments under the distance contract. Seller must provide written response to complaint within 15 days.
Processing of Buyer’s personal data
The store processes only those personal data which the Buyer has provided during ordering (e.g., name, surname, e-mail, etc.). The store forwards personal data to transport service providers to deliver goods. If you unequivocally consented to receive our marketing communications (news, offers), we may contact you occasionally about our services/offers.
For this purpose we may process your e-mail address used for marketing communication. Buyer may opt-out of marketing communications by notifying us at gimenessirdsveikals@gmail.com.
Dispute resolution
For matters not governed in these Terms & Conditions, Buyer and Seller undertake to observe laws in force in the Republic of Latvia. Parties shall resolve disputes by negotiation or correspondence. If disputes cannot be resolved that way, they will be settled in the courts of the Republic of Latvia in accordance with Latvian laws. Disputes between a consumer and Seller may also be referred to the Consumer Rights Protection Centre or EU dispute-resolution institutions.
